The Penalties Faced

If you are convicted of a DUI, it will typically remain on your record for seven years in the State of Michigan. The penalties for DUI convictions become progressively more serious as the number of offenses rises. 

First Offense

A first offense comes with all the following potential penalties and fines:

  • Up to 93 days in jail and up to 180 days in jail if the BAC is .17 percent or higher
  • Fines of from $100 to $500 and from $200 to $700 if the BAC is .17 percent or higher
  • Community service of up to 360 hours

Second Offense

A second offense comes with all the following potential penalties and fines:

  • A mandatory five days in jail that can be extended up to one year
  • From $200 to 1,000 in fines
  • From 30 to 90 days of community service

Third Offense

A third offense comes with all the following potential penalties and fines:

  • One to five years in jail or from 30 days to a year if community service is also ordered
  • From $500 to 5,000 in fines
  • From 60 to 180 days of community service

Vehicle Immobilization

The judge in the DUI case has the discretion to order the immobilization of the defendant’s vehicle or forfeiture of their driver’s license. Both of these are optional for a first offense, but they’re mandatory for any subsequent convictions.
