Drunk Driving / DUI Penalties

The legal consequences of a DUI conviction may include any or all of the following, depending on your criminal record.

DUI / Drunk Driving First Offense:

• A fine of up to $300 and one or both of the following:
• Jail time of up to 93 days.
• Up to 360 hours of community service.
• Restrictions on your driver’s license for 90 days (180 days if controlled substance).
• Vehicle immobilization.
• Four points on your driving record.
• $500 Driver Responsibility Fee for two consecutive years.

DUI / Drunk Driving Second Offense:

• A fine ranging from $200 to $1,000, and one or both of the following:
• Jail time ranging from 5 days to 1 year.
• Community service ranging between 30 to 90 days.
• Revocation and denial of your driver’s license for a minimum of 1 year.
• Confiscation of your license plate.
• Vehicle immobilization for 90 to 180 days.
• Vehicle forfeiture.
• Four points on your driving record.
• Driver Responsibility Fee of $500 for two consecutive years.

DUI / Drunk Driving Third Offense – Felony

• A fine ranging from $500 to $5,000, and either of the following:
• Imprisonment between 1 to 5 years.
• Probation, along with 30 days to 1 year in jail.
• 60 to 180 days of community service.
• For two convictions within seven years or three convictions within ten years, your driver’s license will be revoked and denied for a minimum period of 1 year (minimum of 5 years if there was a prior revocation within seven years).
• License plate confiscation.
• Vehicle immobilization for 1 to 3 years unless the vehicle is forfeited.
• Possible vehicle forfeiture.
• Denial of vehicle registration.
• Four points on your driving record.
• Driver Responsibility Fee of $500 for two consecutive years.
