During the divorce, the spouse who carries the family health insurance is typically required to keep the other spouse covered until the case is finalized. What is the difference between legal and physical custody?

Legal custody is the authority to make major decisions about a child’s life — schooling, medical care, religious upbringing. Physical custody is where the child actually lives. Michigan courts often award joint legal custody even when physical custody is not evenly split. It’s common for parents to share legal custody while the children spend most of their overnights with one parent and structured parenting time with the other.
